The Evaluation of Regulations related to Religious Marriage (Dini Nikah) in Turkiye

Abstract: The validity of religious marriage (dini nikah), the official registration of marriage and the number of divorce rights (talaq) occasionally result in complexities and discrepancies in Turkish society. Since the origin of tension relates to the religious dimension of these practices, the Diyanet, an official religious institution, issued fatwas to guide the Muslim citizens and to appease the negative outcomes of these practices. The note aims to shed lights on the Diyanet's approach towards marriage contracts, to scrutinise carefully the general attitude of scholars, and to analyse deeply the main legal principles of these fatwas. The official legal regulations are also evaluated to clarify the social and legal inclinations of the Diyanet while issuing its fatwas regarding marriage.
