Commentary QUESTIONING UNSTATED ASSUMPTIONS OF INTERNATIONAL CONSTITUTIONALISM

INTRODUCTION The idea of global constitutionalism has attracted the attention of scholars from various fields. Derived from the domestic conception of constitutionalism, it refers to the process of allocation and limitation of power within supranational institutions and its connection with political institutions. Thus, since it is aimed at addressing concerns of legitimacy of international institutions and practices, it analyses the issue of coherence and unity within international law arising from the emergence of autonomous regimes, which is also known as the phenomenon of fragmentation of international law.
