Annual Review of ICSID Cases, 2022

This review summarizes and analyses awards and other decisions delivered by tribunals and hoc annulment committees constituted under the International Centre for Settlement of Investment Disputes (ICSID) between the period December 2021 to November 2022. An unmissable trend evident from the activities of tribunals and annulment committees is that the number of ‘awards’ on jurisdiction and merits is less as compared to the past. On the other hand, the number of ‘decisions’ dealing with different matters has noticeably increased. It would be no shock that the applications seeking disqualification of arbitrators continue to constitute a large share of the procedural orders. But a visible increase is in other applications, such as seeking review of past decisions (on more than one occasion in the same case). As tribunals and annulment committees face more and more of these applications, inevitably, their time would be diverted reducing the number of awards.
