SEXUAL RIGHTS IN THE RELIGIOUS STATE

ABSTRACT
Sexuality and sexual rights as autonomous concepts present challenges to widely held societal views as well as to established legal norms. Community and State structures have struggled to regulate expressions of sexuality and the demonstration of sexual rights. Expressions of sexuality as a pleasurable, aesthetic activity, or as a commercial and business enterprise have been the subject of restraint, scrutiny and in many instances criminalisation. The decoupling of sexual rights from reproductive rights has been particularly unpalatable for many societies and States. Deploying the example of Pakistan, this article highlights that expressions of sexuality remain problematic in Muslim majority States both within the context of heterosexual as well as homosexual relationships.
