Communication Flows in International Economic Law

The recent ‘Economic and Trade Agreement Between the Government of The United States of America And the Government of The People’s Republic of China’ is reminiscent of an era of gun boat diplomacy and unequal treaties underpinned by US unilateralism through Section 301 of the US Trade Act 1974 and accompanying economic sanctions. However, what ever its substantive character – for agreements between nations can indeed be for various reasons in substance unbalanced – this US/China agreement has all the hall marks of a contemporary US attributable style of drafting and language that can be described as being beyond the pale of civilised/courteous/mutually respectful discourse set out in an agreement.
