Comparative Analysis of the Application of WTO Dispute Settlement Mechanism in East Asia Juqian LI
ABSTRACT: The paper analyses the empirical data of three East Asian countries, namely China, Korea and Japan, regarding their application of World Trade Organization Dispute Settlement Mechanism (DSM), the roles they played as a complainant, respondent or third party, and their implementation of DSB rulings and recommendations. It is found that these three countries have been active in the DSM though to varying degree. In addition, this paper examines a number of shared defects in these countries’ participation in the WTO DSM, and proposes some recommendations to enhance the application of DSM and to coordinate and harmonize WTO Members’ steps towards thereto.
