The Role of Artificial Intelligence in Optimising the Use of Islamic Shari’ah in Achieving Transparency to Combat Corruption in Government Contracts in Iraq

Abstract: Corruption is a global scourge that arises from a departure from religious and ethical principles and a weakening of societal values. It is most visibly manifested in governmental administrative corruption, particularly through the abuse of public office for personal gain. The principle of transparency in public contracting plays a crucial role in combating corruption and fostering equality, fair competition, and increased public trust in governmental institutions. Although the Iraqi Constitution does not explicitly enshrine the concept of transparency, it implicitly affirms its significance through its emphasis on popular sovereignty and the principle of accountability. Nonetheless, when assessed against international standards, the constitutional provisions concerning transparency remain insufficient. This note explores the principle of transparency through the dual lens of Islamic legal thought and emerging developments in Artificial Intelligence (AI). The note argues that AI provides advanced technological tools capable of monitoring, evaluating, and enforcing compliance within public procurement processes. The integration of these two frameworks—ethical and technological—holds considerable potential.
